“I can do anything I want and nothing will happen,” Logico G said to Mr D. his nemesis teacher. Mr D was 250 lbs and over six feet tall. He towered at least a foot over his student adversary. The student had been trying to teach Mr D a lesson all year. It now being March, he felt the time had come to make sure that Mr D knew what his rights were as a student. You see Mr D had made him aware that he needed to pick up a milk carton that he was kicking around the hallways a few weeks ago. Mr D had politely requested that he pick up the carton and throw it away. Logico had said about the same thing to Mr D at that time, “You can’t make me do anything. I can do what ever I want and there is nothing you can do about it.” And do you know, the student was right. There was nothing Mr D could do about it. Even if it was reported, which it wasn’t. Restorative Justice required a long list of restorative procedures, which when adhered to, made it pretty useless to even report the incident. But now Logico and his backers surrounded Mr D. They had deduced that because there were no consequences for the milk carton confrontation there would be none for this escalated version.
Mr D stood his ground, “No, you are wrong. There will be consequences.”
“No there won’t,” Logico logically replied. “I’m going to spit on you and nothing will happen to me.”
Mr D took a step back giving him time to take this in and consider his alternatives. He knew that so much of what the boy was saying was true. Student’s were doing horrendous things like lighting the trash barrels on fire and nothing was happening to them other than a parent-teacher conference and a verbal reprimand. They would be back in school the next day as though nothing had happened. So Mr D tried to stay calm but then the student released a volley of ethnic slurs which somehow flipped a switch in Mr D.
“You bitch ass nigger, I’m going to spit on you.” Mr D could not tolerate this ultimate insult to his person and ethnicity. There seemed to be a point at which this person in front of him became more than a child. He represented the attitudes of not only himself but many of the other students on campus who often called him “watermelon boy” or “nigger’ over the brown phone (intra-office phone system) when calling from other classrooms.
The boy let loose a volley of saliva as Mr D stepped back again. The glob of spit hit him on a shoe. Mr D was enraged beyond control as he looked down to see the white mucus on his shoe. He was later to recall that he seemed to go beyond a point at which logic and rational thought controlled his actions. A boy was calling him a “bitch ass nigger” and was treating him as a “bitch ass nigger”.
“You’d better keep that spit in your mouth and go to class or you’ll regret it,” Mr D responded holding up his huge fist in the student’s face.
“You bitch ass nigger, I’m going to spit in your face and there is nothing you can do about it,” Logico relentlessly continued.
“You spit in my face you cock sucking son of a bitch and I’ll do something to your face you will never forget,” Mr D said with his face in the student’s face.
“I’m going to spit right in your face,” the student fearlessly responded shouting right back into Mr D’s face. The student then proceeded to cough up some more spit in the back of his throat to spit in Mr D’s face.
“You are a stupid mother fucker if you think you are going to do that and not get the shit beat out of you,” Mr D said with his huge fist again in the student’s face.
At this point the student stepped back with a smile realizing that he had forced the teacher to compromise himself. He had succeeded. He and his witnesses who conveniently surrounded them would testify to what they had seen. Mr D, however, felt that he had gained himself some time with this eruption of profanity, took out his cell phone and dialed 911. To hell with calling security. To hell with calling an administrator. A call to anywhere on the campus would result in exactly what the student predicted – nothing. Being a seasoned teacher he was going to do what he knew would bring the police and would result in a formal report by the police ending up in the student’s cum. It would also result in an independent investigation which would dispassionately analyze all parties involved unlike the biased approach of Restorative Justice which protects the students and disenfranchises the teachers.
The dispatcher answered the call and said that she would send a unit to the school immediately. A police unit arrived at the school preceded by a call to the Principal. So administrators were on hand when the police arrived. The teacher was sent back to class and the student was held in his grade level councelor’s office.
The police took a statement from Logico, surrounding bystanders, and Mr D. A permanent police report was filed in the student’s cum. The police told Mr D if he ever had any more trouble with Logico, he should notify them and they would come and arrest Logico and take him to Juvenile Hall.
The rest was predictable. The student went through a parent-teacher conference with an administrator in which he lied about spitting at Mr D and of course testified as to Mr D calling him a “stupid mother fucker.” His witnesses backed his version of the story and his parents backed him of course. Logico was sent back to class. The teacher was brought in and given a hand out called “The Code of Conduct with Students” reprimanding him for what he said. And that was the end of it.
My advise to any teacher who finds himself in a situation of unbearable abuse or even physical harm: Practice utmost restraint and call the 911 immediately. Let the Dispatcher or Watch Commander decide whether police intervention is necessary. The police are not under the control of the District’s Restorative Justice policy.
But this has not ended what is probably a sever disciplinary problem on many of our school campuses. I have chosen my words carefully in this story. You may ask why the expletives and racial slurs were not deleted or modified. I want to make it absolutely crystal clear that I want to enrage – totally and completely enrage the reading audience and incite the readers to exact all legal forms of pressure on the states, the school districts and the voters of our country to change policies allowing administrators and teachers to exact more immediate, punitive and corporal consequences on abusive students in order to permanently etch in their minds a fear of ever willfully attacking a teacher like this again.
